Please read these Terms of Use carefully before using this site. By using this site, you signify your consent to these terms. If you do not agree, please do not use the site.

The following legal restrictions and terms of use apply to Havefunteaching.com and any other site owned and/or operated by or on behalf of Have Fun Teaching, LLC or any of its subsidiaries that states it is governed by these Terms of Use and/or links to them (collectively, “Havefunteaching.com,” “Have Fun Teaching,” and/or “we”). Use of this site signifies your agreement to the Terms of Use and was verified at checkout by your acceptance of the Terms of Use.

1. Return & Refund Policy

Memberships and renewals may only be refunded if requested within 24 hours of the purchase or renewal and no resources have been downloaded. It is up to the account holder to cancel the subscription. A subscription may be canceled at any time in your My Account page. Due to the nature of a digital membership, we cannot refund these purchases unless the above requirements are met. When signing up for a membership, you check a box at checkout to agree to our terms of use and this return policy.

If you are unhappy with any product for any reason (excluding all paperback workbooks, USBs, CDs, and DVDs), contact us within 5 days of purchase for a refund or exchange. Your satisfaction is our number one priority. If you have questions or concerns about your order, simply call customer service at 678-345-1111 or email us at [email protected].

If you ordered a Paperback Workbook, you may cancel your order within 24 hours. After 24 hours, we will print and ship the Paperback Workbooks to your address and they may not be returned. If you are not satisfied with a download, you can let us know within 5 days for a refund or exchange. If a return is requested for a USB, CD, or DVD, the buyer must pay a restocking and return shipping cost. Shipping fees cannot be refunded.

All products that are returnable are to be received in their original packaging, in like-new condition, and authorization by Have Fun Teaching is required prior to receiving a refund. Any downloadable content to be refunded, if ordered by mistake, must be immediately destroyed and unavailable for use upon receipt of refund. Refunds issued are done so by the original payment type. If you were invoiced and payment has been received, then a refund will be issued in the form of a check, which may take up to 30 days. If payment was done using a credit/debit card, then a refund will be issued upon receipt of items and may take 7 days to appear.

2. Memberships & Subscriptions

A Teacher Membership allows a single user to print, download, and use resources in a classroom or at home. Resources made available in a Teacher Membership may not be shared with anyone, sold, or distributed to anyone other than students in a classroom or home setting. Due to the increase of spam and fraud, Have Fun Teaching has a monthly limit of one thousand resources, which renews the next month. If a user would like to download more than a thousand resources per month, simply contact us and we can remove this limit. Free trials, if offered, also have limitations of no more than one hundred resources during the trial. Free trials are automatically converted to a Membership after the trial time. Membership fees are auto-renewed according to the date the membership began, depending on whether a Monthly or Yearly membership was chosen.

A School Membership allows an administrator to give a Teacher Membership to up to 30 teachers. Teachers may be added or removed by the administrator. The same monthly resource limits and free-trial terms apply. Membership fees are auto-renewed to the school’s payment method according to the date the membership began. In the event the membership price increases or decreases, members will be notified via email at least 30 days prior to any price change.

Membership pricing may change at any time and for any reason at the sole discretion of Have Fun Teaching. If the monthly, quarterly, or yearly subscription price is increased, members will be notified via email 30 days prior to the price change.

Affiliates

The Have Fun Teaching Affiliate Program awards members a specified amount of money for each person they get to sign up for a Have Fun Teaching membership. This “specified amount of money,” also referred to as “commission,” is subject to change at any time. The program may be terminated at any time at the discretion of Have Fun Teaching, LLC. At the time of termination, any commissions that have not yet been paid out will be paid out and the program will be closed.

Commission payouts will be sent via PayPal within the first week of each month for the previous month’s commission earnings. You can check your Affiliate Reports and Earnings, edit your Affiliate ID, and create unique affiliate links at any time. Affiliates can cancel at any time by emailing us.

Reviews

As a customer, you agree to receive invitations to write reviews for orders and products that you purchase or download on this website. You may opt out of these review invitations at any time using the unsubscribe link included in every invitation email.

3. Use of Materials

In general, all resources downloaded, printed, and used from HaveFunTeaching.com can be used for personal, home, and classroom use. Resources may not be shared with other teachers, sold, or distributed to anyone other than those who have a membership and students in their classroom or homeschool. As a Have Fun Teaching member, a single user may print, download, and use resources for teaching in the classroom and at home.

Have Fun Teaching resources may only be uploaded to an online virtual website, classroom, or application if it is login-protected and not made available to the public. In other words, resources may not be uploaded and made available for download to anyone that does not have a membership. For example, a teacher may upload specific resources to their online portal for their students, but that portal must be login-protected and not visible to anyone other than the students. Uploaded resources to any online portal or application may not exceed 50 resources at one time.

This site is owned and operated by Have Fun Teaching, LLC and, in the case of certain features, its third-party service providers. Unless otherwise indicated, the contents of Havefunteaching.com are the property of Have Fun Teaching and are protected, without limitation, pursuant to U.S. and foreign copyright and trademark laws. No material may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, except that you may download one copy of the materials on any single computer for your personal, non-commercial use only, provided you keep intact all copyright and other proprietary notices. Modification of the materials or use for any other purpose is a violation of Have Fun Teaching’s copyright, trademark, and trade secret rights and others’ proprietary rights.

In the event you download software from the site, the software (including any files, images, and data, together the “Software”) is licensed to you by Have Fun Teaching. Have Fun Teaching does not transfer title to the Software to you and retains full right, title, and interest in it. You may not redistribute, sell, decompile, reverse-engineer, or disassemble the Software. You hereby grant Have Fun Teaching and its agents and licensees a worldwide, royalty-free, fully-paid, perpetual, non-exclusive license to use any material you upload to, distribute through, or post on Havefunteaching.com, in any and all media now known or hereafter devised.

4. User Conduct

Derogatory, harmful, or unlawful conduct is not permitted on Havefunteaching.com. Users may not upload, distribute, or publish any content that is libelous, defamatory, obscene, pornographic, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable, or that would constitute or encourage a criminal offense, violate the rights of any party, or give rise to liability. Unauthorized commercial messages, public announcements, and the unauthorized collection or use of email addresses are not allowed.

Please be aware that, generally, information you post, upload, or distribute through a message board, chat room, blog, or similar feature will be accessible by other users. Please be sure any such information is something you are comfortable sharing with the public.

Users are solely responsible for the content of their messages. Have Fun Teaching is not responsible for the content or accuracy of any information posted, uploaded, or transmitted by users. You acknowledge that Have Fun Teaching may or may not pre-screen content and shall have the right to remove, edit, move, or close any content at any time, for any reason, in its sole discretion. You agree to comply with all laws that apply to your use of the site.

5. No Personal Advice

Any informational materials provided on Havefunteaching.com, including the opinions or recommendations of any authors or moderators, are not intended to substitute for professional educational, medical, legal, psychiatric, employment, or other advice. Have Fun Teaching makes no representations or warranties regarding, and expressly disclaims liability concerning, any action taken by any person following information offered through the site. If you require professional advice, you should consult an appropriately qualified professional in the relevant field.

6. Third Parties

Your correspondence and dealings with third parties you encounter via Havefunteaching.com are solely between you and that entity. Have Fun Teaching shall not be responsible or liable for any dispute, loss, or damage incurred as a result of such dealings. Have Fun Teaching does not endorse, verify, or make representations regarding any third-party advertisements, products, or services, and does not confirm that each user is who they claim to be. It is your sole responsibility to research and verify the legitimacy of any organization or individual, and you are solely responsible for your decision to submit personal information to any third party.

7. Changes to Site

Have Fun Teaching may add, change, discontinue, remove, or suspend any portion of Havefunteaching.com at any time, without notice.

8. User Accounts

Certain portions of Havefunteaching.com may ask you to create an account. If you do, you agree to provide only true, accurate, current, and complete information. You accept responsibility for all activities that occur under your account or password, and you will not sell, transfer, or assign your account or allow others to use it. You are responsible for maintaining the confidentiality of any username and password. Have Fun Teaching reserves the right, in its sole discretion and without notice, to terminate your account and/or restrict your access for any reason, including extended periods of inactivity.

9. Termination

This Agreement is effective until terminated by either party. You may terminate it at any time by destroying all materials obtained from Havefunteaching.com and all related documentation and copies. This Agreement will terminate immediately, without notice, if in Have Fun Teaching’s sole discretion you fail to comply with any term, if you are a repeat infringer of any third party’s rights, or if you engage in conduct that is illegal, tortious, or that interferes with the technological operation of this site. Upon termination, you must destroy all materials obtained from the site and all copies thereof.

10. Disclaimer

Have Fun Teaching makes no representations or warranties with respect to Havefunteaching.com or its contents, which are provided for use “as is” and “as available.” Have Fun Teaching disclaims all warranties, express or implied, including the implied warranties of merchantability and fitness for a particular purpose, with respect to the site and any site with which it is linked. Have Fun Teaching does not warrant that the functions, information, or links will meet your requirements, that operation will be uninterrupted or error-free, that defects will be corrected, or that the site or its server are free of viruses or other harmful components. You (and not Have Fun Teaching) assume the entire cost of all necessary servicing, repair, or correction. Applicable law may not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

11. Limitation of Liability

Under no circumstances, including negligence, shall Have Fun Teaching be liable for any special, incidental, or consequential damages that result from the use of, or the inability to use, the materials on Havefunteaching.com, even if Have Fun Teaching has been advised of the possibility of such damages. Applicable law may not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply to you. In no event shall Have Fun Teaching’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing Havefunteaching.com. You acknowledge that by accessing the site and agreeing to these terms, you may be waiving rights with respect to claims that are at this time unknown or unsuspected.

12. Indemnification

By using Havefunteaching.com, you agree to indemnify, defend, and hold harmless Have Fun Teaching from and against any actual or alleged claims, demands, causes of action, judgments, damages, losses, liabilities, and all costs and expenses of defense (including reasonable attorneys’ fees) arising out of or relating to: (1) your violation of these terms or any law; (2) a claim based on your use of any content on the site; or (3) any material uploaded by you or through your computer. You will cooperate as fully and reasonably as required by Have Fun Teaching in the defense of any claim. Have Fun Teaching reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you will not settle any claim without the prior written consent of Have Fun Teaching.

13. Jurisdictional Issues

Havefunteaching.com is controlled and operated by Have Fun Teaching from its offices in Georgia, United States of America. Have Fun Teaching makes no representation that materials are appropriate or available for use in other locations. Those who access the site from other locations do so on their own initiative and are responsible for compliance with local laws. Software from this site is subject to United States export controls and may not be downloaded or exported in violation of U.S. law, including to any embargoed country or to anyone on a U.S. government denied-parties list. By downloading or using the Software, you represent and warrant that you are not located in, under the control of, or a national or resident of any such country or on any such list.

14. Other

This Agreement shall be governed by and construed in accordance with the laws of the state of Georgia, without giving effect to any principles of conflicts of law. You and Have Fun Teaching each agree to submit to the exclusive jurisdiction of the courts of the state of Georgia and the federal courts of the northern district of Georgia. If any provision is unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity of the remaining provisions, and shall be deemed modified so its purpose can be lawfully effectuated. This is the entire agreement between the parties relating to the subject matter herein.

All material on Havefunteaching.com is protected by U.S. and foreign copyright and trademark laws. To request permission to reprint any material (outside of personal, non-commercial use), please write to:

16. Permission for Web Linking

If you link to Havefunteaching.com, you may only link to the home page, and the link must be in plain text unless otherwise approved in writing by Have Fun Teaching. Any such link must not damage, dilute, or tarnish the goodwill associated with Have Fun Teaching or its intellectual property, nor create the false appearance that your website or organization is sponsored, endorsed by, affiliated, or associated with Have Fun Teaching, and you may not “frame” the site. You may not link from any website that is unlawful, abusive, indecent, obscene, promotes violence or illegal acts, or is otherwise inappropriate in Have Fun Teaching’s sole discretion. Have Fun Teaching reserves the right to terminate any link from any website.

17. Copyright Infringement Claim Notice & Procedure

1. A signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. Identification of each alleged infringing copyrighted work or works.
3. Identification of the allegedly infringing material and information reasonably sufficient to enable us to locate it.
4. Information reasonably sufficient to enable us to contact the complaining party (e.g., an address, telephone number, and email address).
5. A statement that the complaining party has a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner.

Have Fun Teaching reserves the right, at its sole discretion, to change, modify, add, or delete portions of these terms of use at any time.
